1. Introduction

   These Terms of Service ("Terms") govern your access to and use of ClutchNode.com ("ClutchNode", "we", "us", or "our") services. By purchasing, accessing, or using any of our services, you ("Customer", "you", or "your") agree to be bound by these Terms. If you do not agree, you must not use our services.

   
   

2. Definitions

   • Services: Any product or service provided by ClutchNode, including but not limited to game server hosting.

   • Customer Data: Any files, configurations, scripts, backups, saved games, or other content uploaded, stored, or generated by the customer.

   • Abuse: Any behavior or use of services that violates these Terms, applicable law, or harms our infrastructure or reputation.

   
   

3. Account & Eligibility

   1. You must be at least 18 years old or have legal parental/guardian consent to use our services.

   2. You are responsible for maintaining the confidentiality of your account credentials. Any actions taken using your account are your sole responsibility.

      
      

4. Use of Services

   1. You agree not to use our services for any illegal or harmful activity, including but not limited to:

      • Launching or participating in DDoS (Distributed Denial of Service) attacks

      • Hosting or distributing malware

      • Unauthorized access to third-party systems ("hacking")

      • Pirated content or copyright infringement

      • Abuse of system resources

      • Spamming or phishing

        
        

   2. ClutchNode reserves the absolute right to suspend or terminate any service immediately and without notice if we detect or suspect:

      • Any violation of these Terms

      • Harmful or illegal activity

      • Behavior that puts our infrastructure, other clients, or reputation at risk

        
        

   3. In case of termination for Terms violations, no refund will be issued.

      
      

5. Customer Data & Responsibility

   1. You are solely responsible for all files, data, configurations, and content uploaded to or generated on your server.

   2. ClutchNode is not responsible for any data loss, corruption, accidental deletion, or unauthorized access. This includes but is not limited to:

      • Hardware failures

      • Software bugs

      • Human error

      • Security breaches

        
        

   3. We do not guarantee the availability of backups. While internal backups may be performed occasionally for disaster recovery, these are not guaranteed, accessible, or complete, and customers should maintain their own backups at all times.

      
      

6. Availability & Maintenance

   1. While we strive for high availability, ClutchNode does not guarantee 100% uptime. Downtime may occur due to:

      • Scheduled maintenance

      • Software or hardware failures

      • Network disruptions

      • Force majeure or acts beyond our control

        
        

   2. ClutchNode reserves the right to perform emergency maintenance or suspend services temporarily to protect the network or infrastructure.

      
      

7. Billing & Refunds

   1. All payments are due in advance. Services are activated only after successful payment.

      
      

   2. Failure to pay on time may result in temporary suspension or permanent termination of your services.

      
      

   3. Unless otherwise stated in writing, ClutchNode does not offer refunds for partially used billing cycles or early cancellations.

      
      

   4. ClutchNode may terminate services for any reason, including violations of these Terms or suspected abuse, without refund.

      
      

8. Data Retention

   1. Upon service cancellation, expiration, or suspension, ClutchNode is not obligated to retain any data associated with the terminated service.

      
      

   2. Data may be permanently deleted at any time after service termination.

      
      

9. Intellectual Property

   1. All content, branding, and intellectual property on ClutchNode.com remains the sole property of ClutchNode unless otherwise stated.

   2. You retain ownership of your content, but grant us a limited license to host and serve that content as needed to provide the service.

      
      

10. Limitation of Liability

    1. ClutchNode shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to:

       • Loss of data

       • Loss of revenue

       • Service interruption

       • Security breaches

       • Third-party misconduct

         
         

    2. In any event, our total liability shall not exceed the total amount paid by you in the 30 days prior to the incident.

       
       

11. Termination

    1. You may cancel your service at any time through our client portal. No refunds will be provided unless explicitly stated.

       
       

    2. We reserve the right to:

       • Suspend or terminate services without notice in the event of a breach of these Terms

       • Take legal action if necessary

         
         

12. Modifications to Terms

    ClutchNode reserves the right to update these Terms at any time. Changes will be posted on our website. Continued use of our services after changes are made constitutes acceptance of those changes.

    
    

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands, and any disputes will be exclusively submitted to the competent court in Amsterdam, unless mandatory consumer protection laws state otherwise.
